To claim the Social Security Disability Tax Credit, you must either be a U.S. citizen or a resident alien (see this website for more information). Your income must be below a certain level, and you must also be under 65 years old at the end of the tax year (if you are over 65, you may be able to claim the “Elderly Credit” instead, which has no disability requirement). In addition, you must be unable to perform any “substantial gainful activity” (anything done for pay) because of a serious mental or physical condition. A doctor must confirm that your condition is either terminal or will likely last for at least a year.
